2. Customer: The person using the online store and delivery service.
3. Products / Goods: Products ordered by the customer.
4. Perishable Goods: All sweets and namkeen products.
5. Non - Perishable Goods: All other products except perishable products.
6. Products: The products delivered to the recipient will be generally as per the description of the article and as per the picture chosen by the customer.

Exotica Global Inc. reserves the right to add, delete, alter or modify these terms and conditions at any time. The Customer is therefore advised to read carefully these terms and conditions each time he/she uses the shopping service(s) of Exoticabazaar.com. By placing an order the client is authorizing the company to pass on the order to the respective merchant / vendor and make sure the product is delivered to the given address. While rendering the service the company is acting only as an authorized representative of the client and not as his agent or in any other capacity. The company shall be handling the material only as a service provider and its liability shall be restricted to that of a bailed under the contract Act. Nothing contained herein shall create or be deemed to create or construe a relationship between the parties such that Exoticabazaar.com is regarded as a seller or purchaser of the Vendor / Merchant's products and all sales and purchases of the Vendor / Merchant's products pursuant to an order placed on the Exoticabazaar.com are transactions between the customer placing an order for the same on the Exoticabazaar.com and the Vendor / Merchant. Exoticabazaar.com is an online store for the vendor / merchants to host and sell his merchandise and a facilitator of the sales contemplated herein.
• The sender is bound to above terms and conditions once he/she places the order. The sender should read the above terms and place the order with Exoticabazaar.com only if they are acceptable by him/her.
• Perishable products like Sweets shown here are indicative. We do our best to give better result than shown. It may be possible that actual arrangement varies due to availability and other reasons beyond our control. However, we always ensure full or higher value to our customers.
• Exoticabazaar.com shall try its best for prompt delivery. Delivery schedule varies 2-7 days for the eatery products and 2-15 days for Handicrafts & Home Decor depending on the destination city or town. For the rare products shipment time will vary. Delayed/early delivery for whatever reason shall not entitle the customer for any damages or compensation.
• Requests for cancellation of orders will not be entertained; however, in rare cases it can be considered. The decision of Exoticabazaar.com will be final in this case.
• We reserve the right to cancel any order without providing any reason. This will be regardless of whether the payment has been confirmed / received. Payment for the cancelled orders will be refunded and the user will be informed.
• Refund for cancellation of order by Exoticabazaar.com will be settled at the earliest as soon as the formal procedure is completed.
• For orders in which problem arises owing to the mistake of the user e.g. wrong address or incomplete information or recipient not reachable, no refund will be given. Redelivery charges, if any, will be borne by the user.
• We never recommend ordering the products if there is no courier service in that area. No Claim will be entertained if the product can’t be delivering from the courier company due to no serviceable area.
• The Company will not be responsible for any loss or damage/delay direct to the consignment or consequential, caused due to incorrect address, any act of God, such as accidents, any natural calamity, war, riot, commotion, strike, Local/Political Disruptions, Air / Rail / Road Disruptions / Delay or any other cause whatsoever beyond the control of the Company. No claim for loss / damage / delay will be entertained by the Company in such events.
• The company shall not be liable for any consequential or special damages or loss (including loss of income, profits, makers, reputation, use of contents or loss of any opportunity) or other indirect loss arising from the loss, damage, delay, mis-delivery or non-delivery of your consignment even if we had knowledge that such damages or loss might arise. The company shall not liable if your consignment or any part of it is lost, damaged, delayed or more delivered or not delivered at all as a result of ACT OF GOD, FORCE MAJEURE, which shall include war, accident, acts of public enemies, strikes, embargoes, perils of the air, local disputes, civil commotions, National or local disruption in air or ground transportation networks, mechanical problems to modes of transport or machinery or patent defects or inherent vice in the contents of the consignment.
• The user agrees to give the correct information which is true and authentic. We reserve the right to confirm the information provided by the user.
• We will not be held liable for any credit card fraud that occurs on its website. Users have to use only their card when they make their payments. The liability of using a fraudulent credit card lies on the user and the responsibility to establish otherwise shall exclusively be the users’.
• In case of any complaint against the quality of product we shall redeliver the product subject to satisfaction of recipient. But all such claim should be raised within 24 Hours of delivery. Refund can also be made depending on nature of complaint and any decision to refund is sole prerogative of Exoticabazaar.com.
• Prices of items which are subject to MRP restrictions are being sold on the website after adding up costs of our services, delivery and online transactions cost.
• If you wish to select from a particular shop for Sweets and any other eatery items we will not be responsible for the quality of product, if the quality is not found up to the mark.
• We do try to deliver well within your mentioned date and time. Thought we deliver on the date we promise, the time may vary based on the availability of the receiver and our service in your area.
• The various logos/Trademark backed by product being sold by us on the website belong to respective companies and they are the owner of said Logo/Trademark.
• Orders received after 2 Pm IST shall normally be processed as next day orders. A phone call to us after placement of such urgent orders will be appreciated.
• We are not responsible for the breakage of any products as the packaging is done by the vendor itself and thereafter processed to be dispatched through courier.
• The condition of refund in the eatery products of the money is when the product received is rotten condition.
• The returned goods must not be damaged, altered, used, torn or worn out in any way. Under such situation, the goods may not be accepted by us. In Handicrafts/Home Décor company is not liable to pay courier charges. The charges for shipping the returned goods as well as handling charges shall be borne by the customer.
• There is sometime a possibility of extra charges like Octrai, Taxes or Duties which are to be borne by the recipient at the time of delivery. Please note that Exoticabazaar.com does not control these charges as the Octrai & Taxes are applicable in some states in India and for some International deliveries duties may be levied as per the country norms.
• Exoticabazaar.com reserves the right to dispatch the gift items separately, not as a single package, if certain items in the package are not acceptable by certain couriers.
• The Company holds the right to destroy all records of delivery and other connected documents after 90 days of booking.
• In the unlikely event of a dispute relating to the services of Exoticabazaar.com, the dispute shall be subjected to the jurisdiction of Ghaziabad (India) courts.
• Exoticabazaar.com does not, in any way, claim ownership or right over the Trademarks, Brands and Company Names used at this site, which are owned by their respective owners/companies. References to these products and company trademarks are used solely for the purpose of identifying the products supplied at this site.
• The product/services provided on this site are without warranties of any kind. Exoticabazaar.com does not warrant that the products/services offered will be exactly similar, error free, or that the defects will be corrected.
• Exoticabazaar.com will deliver exactly the same products displayed on its web pages and from the same sources indicated. However, in certain unavoidable circumstances arising due to non availability of products from indicated sources, it reserves the right to change the source and deliver approximately similar kind of product. If similar kind of product is not available, Exoticabazaar.com will inform the sender to change the order or wait until it becomes available.
• Company agrees to provide proof of deliveries to the Customer against the consignments booked and delivered; as a soft copy as provided by the logistics company and not the physical copy however not providing of such proof will not be pre-condition for payment to the Company by the Customer, in the interim should a requirement arise for a dispute/assurance of delivery, company would provide the necessary records in soft format as provided by logistics company.
• The customer undertakes and agrees with the company, that they shall not permit any other person who has an interest in the consignment to bring a claim or action against us arising from the carriage, even though we may have been negligent or in default and if a claim or action is made, customer will indemnity us against the consequences of the claim or action and the cost and expenses we incur in defending it.
• Returns for Handicraft/Home Decor category will be accepted only for Damaged/ Defective products. Refund will be provided only in case replacement for the same product is not available. Please do not accept any products with damaged/ tampered packaging (excludes normal wear & tear and markings on the outer surface of the package, acceptable in the transit process) Products/ Items should be UNUSED .Products should be returned in their original packaging along with the original price tags, labels and invoices. It is advised that the return packets should be strongly and adequately packaged so that there is no damage of goods in transit. Any products damaged post delivery to customer, shall not be accepted for return.
• In case the ordered products comprise of products from more than one supplier, you may receive multiple deliveries.
• All the terms & conditions printed overleaf of consignment note of the logistics partner are also binding on the Customer.
